 • What is a class action?

A lawsuit is filed as a class action because the number of injured parties is numerous and filing multiple separate lawsuits would waste judicial resources. Class actions benefit most injured parties that typically do not have the time or resources to sustain an individual action. An individual is often at a great disadvantage when in dispute with a large corporation. An individual's time and resources are limited, and the amount by which he or she has been damaged may not justify the expenditure necessary to get compensated. Class action lawsuits give the average person the ability to take on even the largest corporate or private entities and have a chance of redressing the wrong done by these entities. The class action vehicle allows many individuals who have been hurt in a similar way to join together in pursuit of a recovery to redress the damage they have suffered.

While only several entities or individuals typically represent an injured group or "class" in a class action lawsuit, each member of the injured class is entitled to their "pro rata" share of the litigation fund upon successful resolution of a class action.
